1.What is the meaning of “seaworthiness of a ship”?
Suggested answers:
To provide a seaworthy ship is a carrier’s duty provided under Article 3 of the Hague Rules. It requires that the carrier shall be bound before and at the beginning of the voyage to exercise due diligence to make the ship seaworthy. Otherwise, the carrier will be liable for the damages resulting from an unseaworthy ship. The seaworthiness includes several factors:
 (1) The type of the ship;
 (2) The type of the cargo;
 (3) The competence of the crew, and
 (4) The conditions of the equipment, even the weather, and so on.

2.What is the meaning of “ force majeure”?
Suggested answers:
Force Majeure is a clause in long-term contracts that terminates the contract in the event of unforeseen events. Sometimes these unforeseen events are spelled out such as war, civil strife, revolution, long-term labor disputes or other unforeseen natural or man-made events such as earthquakes, etc.

四、 案例分析题(本大题共 3小题,每小题 20分,共 60 分)
1.Suggested answers:
(1) No, because the carrier could only deliver the goods discribed by the bill of lading to the holder of the original one, and as the bills of lading used in this case are order bills of lading, they must be transferred by endorsement rather than mere delivery.
(2) Yes, as the carrier made a misdelivery, the good-faith holder was entitled to sue the carrier for damages


2. Suggested answers:
(1)Yes. Because the letter of indemnity didn’t defend against a third party.
(2)Yes. Because Fuji Electric issued the letter of indemnity which made the shipping company issued the clean B/L.
(3)No. Because the insurance company shouldn’t be responsible for the losses of cargo caused by improper packing.
(4)Ronta should lodge a claim against the shipping company for issuing B/L unfaithfully.


3.Suggested answers:
(1) No, because A had performed his duty of keeping the ship seaworthy and the damage was happened after the ship sailed away from Dalian Port
(2) Yes, because the fire was caused before sailing from Guangzhou Port and it was due to the sailor’s negligence
